These Terms of Use are a binding contract between you and Krestrel ("we", "us", "our", "Site"). It contains the rules and restrictions that govern your use of Krestrel's products and services (referred to below simply as "Krestrel"). If you have any questions, comments, or concerns regarding these Terms or our products and services, please contact us at [email protected]. Using Krestrel in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use Krestrel. These Terms include everything in this document, as well as those in the Privacy Policy, If you don't agree to all of the following, you may not use or access Krestrel in any manner. You represent and warrant that you are of legal age to form a binding contract. As detailed further below, you may not and must not use Krestrel if you are under 18 years old.
Creating an Account
You will be required to provide an email to sign up for an account, receive notifications, and select a password. You agree that you will only use Krestrel for your own personal or organizational use, and not on behalf of or for the benefit of any third party. You may not transfer your account to anyone else without our prior written permission.

First and foremost, all the information about the contacts, relationships, and users you put on Krestrel are yours and private to you.
Acceptable Use Policy
You are responsible for all your activity and content you create in connection with Krestrel! Make sure that you use Krestrel in a manner that complies with the law. If your use of Krestrel is prohibited by applicable laws, then you aren't authorized to use Krestrel. We can't and won't be responsible for you using Krestrel in a way that breaks the law. You also agree that you will not use Krestrel in a manner that:
- Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information of or relating to Kresterl
- Is fraudulent or threatening
- Stores illegal information or data
- Obtains or attempt to access or otherwise obtain any materials or information through any means not intentionally made available or provided for through Krestrel.
- Violates any applicable local, state, national or international law, or any regulations having the force of law
Limitation of Liability
You expressly understand and agree that Krestrel will not be liable for any indirect, incidental, special, consequential, exemplary damages, or damages for loss of profits including but not limited to, damages for loss of goodwill, use, data or other intangible losses (even if Krestrel has been advised of the possibility of such damages), whether based on contract, tort, negligence, strict liability or otherwise, resulting from: (i) the use or the inability to use the site or any related information; (ii) unauthorized access to or alteration of your transmissions or data; (iii) statements or conduct of any third party (including users) on the site; or (iv) any other matter relating to the site. in no event will Krestrel's total liability to you for all damages, losses or causes of action exceed one hundred dollars ($100). some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. accordingly, some of the above limitations set forth above may not apply to you. if you are dissatisfied with any portion of the site or with these terms of use, your sole and exclusive remedy is to discontinue use of the site. without limiting the foregoing, if you are a user from new jersey, the 'disclaimer of warranties' and 'limitation of liability' sections above are intended to be only as broad as is permitted under New Jersey law. If any portion of these sections is held to be invalid under New Jersey law, the invalidity of such portion shall not affect the validity of the remaining portions of the applicable section.
No Warranties
Krestrel is provided to you on an "as-is" basis. This means we provide it to you without any express or implied warranties of any kind. That includes any implied warranties of merchantability, warranties of fitness for a particular purpose, non-infringement, or any warranty that the use of Krestrel will be uninterrupted or error-free. Accordingly, we do not make any representations or warranties about any content contained in or accessed through Krestrel, and we will not be responsible for the accuracy, copyright compliance, legality, or decency of material contained on our products and services.
Termination
You agree that Krestrel, in its sole discretion, may suspend or terminate your account (or any part thereof) or use of the Site and remove and discard any content within the Site, for any reason, including, without limitation, for lack of use or if Krestrel believes that you have violated or acted inconsistently with the letter or spirit of these Terms of Use. Any suspected fraudulent, abusive or illegal activity that may be grounds for termination of your use of Site, may be referred to appropriate law enforcement authorities. Krestrel may also in its sole discretion and at any time discontinue providing the Site, or any part thereof, with or without notice. You agree that any termination of your access to the Site under any provision of this Terms of Use may be effected without prior notice, and acknowledge and agree that Krestrel may (but has no obligation to) immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Site. Termination of your account or access to any component of the Site will not terminate Krestrel's rights to your User Content. Further, you agree that Krestrel will not be liable to you or any third party for any termination of your access to the Site.
